TERMS & CONDITIONS
The company shall sell and the purchaser shall purchase all goods and services in accordance with these terms and conditions. All such contracts will be subject to the overriding presumption that these terms and conditions will prevail and that any subsequent documents will have no legal effect.
The purchaser shall be responsible to the company for the accuracy of the terms of the order and for giving the company the necessary information relating to the goods and services to enable the company to perform the contract in accordance with its terms. The purchaser shall indemnify the company against all loss, damages, costs and expenses incurred by the company due to the inaccuracy of the order submitted by the purchaser or the inability of the company to perform the contract for whatever reason.
On completion of placing your order online you will receive an order acknowledgement, sent to the email address you have provided when you placed your order, to confirm stock availability and delivery date.
Failure to deliver on time due to stock availability will not be sufficient cause to hold the company responsible for any losses, costs, damages or expenses, consequential or otherwise suffered by the purchaser.
Unless otherwise stated prices are inclusive of vat.
Delivery charges include vat also and the “free delivery” offer purchase limit may be subject to change at any time but would not change once you have placed your order.
All prices and discount rates are subject to alteration without notice and the applicable prices shall prevail at the time the order is placed.
From time to time we may offer products at sale or promotional prices and any such offers will apply to selected products and be subject to availability.
DESPATCH AND DELIVERY
Despatch and delivery are based on the company’s best information at the time quoted but such date should be regarded as approximate only.
Estimated time of arrivals given are an approximate only, your delivery can turn up at any point between the hours of 8am and 5pm on the agreed delivery date so someone must be on site all day to accept delivery.
Failure to despatch or deliver at the time stated will not be sufficient cause for cancellation and the company will not be liable for any losses, costs, damages or expenses consequential or otherwise suffered by the purchaser.
The delivery address must be easily accessible by a fire engine size vehicle. The delivery driver has the right to refuse to deliver the goods if he deems the location unsafe to deliver to or there is insufficient help to off load the goods.
There must be one able bodied person available to assist the driver in off loading and carrying laminate worktops and two for all solid surface worktops. Worktops can weigh up to 120kg.
Delivery is to kerbside only but the driver will assist carrying the worktops in to the nearest point should you require.
Failed deliveries due to the customers fault will incur charges for restocking and re-delivery.
Should One Stop Worktops make an error in delivery we will endeavour to re deliver on the next allocated delivery day to your area.
Failure to deliver on the date specified due to reasons beyond our control such as closed roads, floods, snow, ice, local events and accidents etc. will not render the company liable for any costs incurred by the customer.
The company cannot be held responsible should you have removed your old worktops, got a fitter on site or started your kitchen fit before receiving and checking your delivery of worktops.
Payment must be made in full at time of order. Payment can be made through the website (PayPal/Payzone) or by phone using our secure Payzone system. Payment can also be made by cheque made payable to One Stop Worktops Ltd and posted to One Stop Worktops Ltd. Unit B3 Bankfield Trading Estate, Coronation Street, Reddish, Stockport, SK5 7SE.
Delivery will not be made until cleared funds have been received in to our account.
Goods remain the property of One Stop Worktops until payment in full has been made.
Payment reference on your card statement, if paying by card/ Payzone, will be shown as One Stop Worktops Ltd.
If for any reason the order is cancelled after payment but at least 48 hours before delivery is due, then a full refund will be made using the same method as payment. Cancellations made with less than 48-hour notice prior to delivery may incur a restocking fee of 20% except in the case of goods that have already been fabricated where no refund can be given.
Non faulty or non-damaged goods may be returned providing they are in the original intact packaging and are in a re-sellable condition but will be subject to a restocking charge which equals 20% of the total value of the goods being returned.
Cancellations will not be accepted unless you notify us within fourteen (14) days from the date of delivery.
All returning carriage costs will be the responsibility of the purchaser.
SHORTAGES OR DAMAGED OR FAULTY GOODS
All products are despatched to you in good condition by ourselves or our specialist delivery agent.
Please inspect all goods on delivery for damage or faults. All damages or faults must be reported to us in writing, stating original invoice number and delivery date, within 48 hours.
It is the responsibility of the purchaser to check for damages, faults or shade differences before working on or fitting the product.
The company can not be held responsible should you have removed your old worktops or started your kitchen fit before receiving and checking your delivery of worktops. Any costs incurred will be the responsibility of the purchaser.
RISK AND TITLE
Goods shall remain the property of the company until payment in full has been received by the company.
We try to specify accurate dimensions for every product listed on our website. Whilst we try to be as accurate as possible, all sizes, weights and measurements are approximate only.
We have made all efforts to display all product colours accurately. However, we cannot guarantee that the image displayed on your monitor will accurately reflect the true colour of the product delivered to you and we will always advise you to use our sampling service to ensure you are happy with your choice before ordering. Please note on multi-colours designs the sample piece may not display all decors throughout the sample. Please Google the full name of your worktop choice to see it in situ or contact the manufacture.
All fabrication work has a + / – 3mm tolerance.
Once fabrication work has begun on any product, orders cannot be cancelled or refunded as items are no longer in a re-sellable condition.
All fabrication work is done exactly to the pictures/ sizes you, the customer, provide us with (excluding the + / – 3mm tolerance).
If fabrication work has been completed and done so incorrectly due to the customers own fault, refunds will not be accepted however if the incorrect work is a fault of the companies then we will endeavour to rectify the issue at the earliest convenience.
All fabrication work done is based on the walls of the room the fabricated items are being installed into are square. If the fabrication order has been completed and it is later found out that the walls are out, we, the company cannot be held liable.
We will not be held responsible if at the point of your job beginning that we find you have not ordered enough worktop.
PUBLICATION OF COMMENTS ONLINE
You agree that we can publish any comments that you send to us regarding the quality of our products or service on our website. We may use your name and town of residence, but we will not publish such information as your email address, telephone number, website address or street address.
We aim to give excellent service, however, there may be a time when a customer has a complaint that they feel has not been dealt with fairly for whatever reason. If this is the case you agree that before posting any negative comments on any website, news group, blog, social networking site or other online resource you agree to write or email us to explain your grievance allowing us 14 days to resolve the problem.
If you are still not satisfied with our response after that time you agree to include any response, we gave regarding your complaint in any online publication you make in order to give a fair and balanced view to any subsequent readers.
HOW WE MAY USE YOUR PERSONAL INFORMATION
We will not pass your personal information to any third party without your consent and we will only use the personal information you give us to, supply and deliver the products and process your payment.
Here at One Stop Worktops, we strive to deliver a great service to every customer and we make every effort to ensure that the goods advertised for sale on our website are described accurately. However, the descriptions of goods on the website do not form part of the contract between you the customer and us the supplier. They are designed to represent a general idea of the goods. You should always ensure that the goods which you are purchasing from us are suitable for your intended needs. We do not give any warranty that the goods which you purchase from us, are or will be suitable for your intended needs.
We will not be liable to you for any loss or damage which you may suffer as a result of any breach of contract by us, including, but not limited to, consequential loss to you and/or loss or damage to the property of third parties. In any event our liability to you arising directly from our negligence will not exceed the invoiced value of the goods. Nothing in this clause will limit our liability for death or personal injury resulting from our negligence. This clause does not affect your statutory rights.
We make every effort to ensure our website is free from viruses or defects. However, we cannot guarantee that your use of this website or any website accessible through it will not cause damage or disruption to your computer. It is your responsibility to provide adequate protection for your equipment which you use to access our website. We will not be liable to you or to anyone else for any loss or damage which may be caused to any equipment arising as a result of your use of this website.
